Terms and Conditions (T&C)
Preamble
Depending on the booking channel the BERLINLOFTS UG T&C’s vary.
Section A
1. Reservation and booking procedure
The booking will be valid as soon as BERLINLOFTS UG confirms the booking. We will confirm the first booking we get for a booking period. To keep a valid reservation you need to fulfil the payment plan and provide additional information like guest names and addresses, so that Berlinlofts UG will be able to fulfil the administrational requirements of the Berlin state government.
2. Payment plan
The standard payment plan is 100 % payment during the booking process. Other payment plans are available only on request.
3. Cancellation and rebooking
3.1. Cancellation by the Client
The Client can cancel the booking prior to the arrival date. The cancellation has to be done in written form.
The costs of full or partial cancellation are given in the table below:
- earlier than 30 days prior to arrival date no cancellation charges
- from 30 days to 16 days prior to the arrival date 25% of the total rental fees
- from 15 days to 4 days prior to the arrival date 50% of the total rental fees
less than 4 days prior to the arrival date 100% of the total rental fees.
3.2. Cancellation by the Berlinlofts
Berlinlofts can cancel the booking prior to the arrival date in case the apartment is not available any more in the booked period due to law or force majeure. The cancellation has to be done in written form. The client will be reimbursed his upfront payment in this case.
3.3. Rebooking in favour of a third party
The Client can transfer the booking at any time to third party. The Client and the third party will be liable for the rental cost as a joint debtor.
4. Liability
Other than for death or personal injury caused by the negligence of Berlinlofts, the liability to the Client is limited to the price of the booking. Unless BERLINLOFTS UG is liable under the above clause, the Client indemnifies BERLINLOFTS UG from and against any and all liability and any claims, proceedings or damages resulting or arising from the booking, event or function, the Client, guests or any outside contractors of the Client. BERLINLOFTS UG will not be liable for failure to perform to the extent that the failure is caused by any factor beyond its reasonable control. Clients are responsible for any damage caused to the allocated apartment, furnishings, utensils and equipment in them by any act, omission, default or neglect of the Clients, their guests or sub-contractors and will pay to BERLINLOFTS UG on demand the amount required to make good or remedy any such damage.
5. Dogs and other Pets
Pets are not accepted.
6. Cleaning
The basic cleaning has to be done by the Client. This includes the cleaning of the kitchen equipment and objects of utility as well as to empty the garbage cans. The final cleaning will be done by Berlinlofts. Cost of the final cleaning are given on the rental offer.
7. Noise Prevention House Rules
7.1 Each tenant is responsible for ensuring that avoidable noise in the apartment, in the house, the yard and the property does not occur. Volume of radios, TV, CD player and so on have to be put down to reasonable levels which do not disturb other neighbours. Special consideration is the time from 1pm to 3pm and in particular between 10pm and 6am in the night rest time.
7.2 Celebrations and parties are not allowed. Under special circumstances by prior arrangement (tenancy agreement before closing) small events can be permitted by the landlord.
8. Place of fulfilment and jurisdiction
Place of fulfilment and jurisdiction is Berlin in Germany.
Section B

The reservation and booking procedures depend on the particular booking channel.
BERLINLOFTS UG will confirm your booking through the booking channel and through e-mail directly to the customer.To keep a valid reservation, you need to fulfil the payment plan of the channel and provide additional information for us, like guest names and addresses, so that BERLINLOFTS UG will be able to fulfil the administrational requirements of the Berlin state government.
2. Payment
The payment trough a booking channel like the one listed above includes the payment procedures of the booking channel and accordingly their T&C’s will be valid for all payments.
3. Cancellation and rebooking
The cancellation of a booking will be handled according to the T&C’s of the booking channel.
